There is no ambiguity here to hide behind. Section 19 of the Employment Act 1955 requires an employer to pay wages no later than the seventh day after the last day of the wage period. The wage period itself cannot exceed one month.<\/p>\n<\/div> That is the whole rule. It does not contain an exception for a slow client, a delayed invoice, or a difficult quarter. The obligation to pay on time sits with the employer regardless of whether the employer has been paid, because the employee’s wage is not a share of the company’s fortunes. It is the agreed price of work already done.<\/p>\n\n\n\n This is the part employers resist, because it reframes something they think of as sympathetic into something that is not. When a business pays its staff late to manage its own cash position, it is funding its operations with its employees’ money.<\/p>\n\n\n\n The worker has delivered the full month of labour. Withholding their pay past the deadline turns that labour into an unsecured, interest-free loan the employee never agreed to make, usually the employee who can least afford to. A supplier in that position would charge interest and stop delivering. An employee is simply expected to wait, and to be understanding about it. The imbalance is the point, and it is the reason the law fixes a hard deadline rather than leaving it to goodwill.<\/p>\n\n\n\n Set aside the ethics and the exposure is still real. Failing to pay wages within the statutory period is an offence, and the general penalty under Section 99A of the Employment Act runs to a fine of up to RM50,000. Because the failure can be counted per affected employee, a single late payroll across a workforce is not one exposure but many.<\/p>\n\n\n\n The larger cost is quieter. Nothing corrodes trust faster than an employee wondering, every month, whether their salary will actually arrive on time. It is a process problem.
